In the Matter of Legislation
re Bay Area Air Pollution
ET ,
Control District.
The Board of Supervisors of Contra Costa County having
reconsidered its position with respect to new legislation per-
taining to the Bay Area Air Pollution Control District, hereby
RESOLVES that it proposes to sustain its original position
whereby it will agree that a maximum of 10 increase in the
District ' s tax will receive Board support, provided that some
procedure is set up for local enforcement on a reimbursable
basis .
IT IS FURTHER RESOLVED by this Board that an accept-
able procedure would be to add to or revue sections of the
California Health and Safety Code as indicated by the attached
four sheets .
BE IT FURTHER RESOLVED that copies of this resolution
be forwarded to the, Honorable Gorge Miller, Jr., Senator, 17th
District; the Honorable Jerome R. Waldie, Assemblyman, 10th Dis-
trict; and the Honorable John T., Knox, Assemblyman, llth District.
PASSE) and ADOPTED this 12th day of April, 1961, by the
following vote of the Beard;

Thomas John Coll, Edmund A. Linscheid, Joseph
S. Silva.

Add to Health and Safety Code a new section numbered
section 24360,9:
"See. 24360,9,. When complaint is made to the
district that the; local Suforc sxt off iear of any
city or county has not performed a duty devolving
upon him by the provisions of section 24354.11, or
is .not proceeding with due diligence or in the proper
mariner in the performance of such duty, the district
control officer shall make an investigation. If he
Finds the charge to be true, the district control
officer and other appropriate district officials shall
diligeantly prosecute an action to secure the issuance
of an injunction restraining the person or persons who
are violating the provisions of this chapter or any
regulations adopted thereunder,"

section 2A.534,11.-
"See.
4354,11:"See. 24334.11. Upon receipt by the district of
notice from any city or county within the; district
that such city or county will enforce within its
limits, the provisions of this chapter and the
regulations adopted thereunder and designating
the city or county official who shall be rapponsible
for such enforcement, the district shall enter into
negertiations with each city or county giving such
notice to reach an agreement for the reimbursement
of the reascnable costs expended by each of said
cities and unties for such enforcement. Thereafter,
it shall be the: duty of the city or county official
so designated to enforce the provisions of this
chapter and of regalatims adopted hereunder within
the limits of such cities or counties.
''This section shall be in the alternative to any
Other enforcement provisions of this. law."
Amend Health and Safety (ode section 24370,1 by adding
the following at the end of that section:
"Each of the above mentioned estimates and
determinations shall include the amounts of .money
required for reimbursement of cities and connti es
which have: given notice to the district ander
section 24354.10 or 24354.11, and said amounts for
each such city and county shall be net forth in an
annual budget prepared by the district."

"Whenever a city or comty within the district
givers notice to the district of its desire to
ccatract with the district to perform within its
limits the services of observation* surveillance
and fact finding in connection with the enforcement
of this chapter and the district's regulations there—
under, the district shall enter into negotiations
with each of such: cities and counties with a view
to reaching agreemOnt on such contracts. Such
contracts shall provide, axong other things:
(1) That the city or county official or officials
designated by the city or county for the
performance of such service shall report to
the control officer all available information
in connection with any violations of this
chapter or regulations, thereunder occurring
within: the limits of such cities or counties
for proceedings by the central officer in
accordance with .Section 243:62.5.
(2) That such cities and counties shall be
reimbursed by the district for the reasonable
cost of the performance of such services.
(3) That the district shall, provide for such
cities and counties specisl technical services
