In the Matter of the Abandonment of RESOLUTION & ORDER

RESOLUTION N0. 2905
The Board of Supervisors of Contra Costa County RESOLVES THAT:
On February 11, 1964, this Board passed a resolution of intention
to 2 )anaon e county highway described below and fixing Tuesday,
March 24, 1964, in its chambers, Hall of Records, Martinez,
California, as he time and place for the hearing of said resolu-
tion and ordered said resolution to be published and posted as
required by law, which was done as shown by affidavits on file
with this Board; and
Said hearing was held at said time and place; and
Said hearing was continued until April 7, 1964; and
This Board then and there heard and duly considered evidence
offered concerning the abandonment, and
This Board hereby finds that the hereinafter described County
Highway dedicated to public use, is unnecessary for present or
prospective use, and it is HEREBY ORDERED ABANDONED.
DESCRIPTION:
Portion of Brook Street as shown on the map of Bickerstaff
Tract filed December 5, 1918 in Book 17 of Maps at page 355,
Contra Costa County, California, described as follows:
That portion of Brook Street lying southerly of the south
line of the parcel of land described in a deed from Leo J.
Coleman et al. to Contra Costa County filed July 22, 1940 in
Book 554 of Official Records at page 122, and lying westerly
of the west line of lot 58, Block 7, and lot 62, Block 8 of
said Bickerstaff Tract (17 M 355) .
EXCEPTING AND RESERVING THEREFROM, pursuant to the provisions
of Section 959.1 of the Streets and Highways Code, the easement
and right at any time or from time to time for the owner of an
existing facility used for utility purposes, including but not
limited to sewer lines, gas lines, and ditches to maintain,
operate, replace, remove, renew, and enlarge existing lines of
pipe, conduits, and other convenient equipment and fixtures
for the operation of existing facilities, including access to
work on the facilities and to protect the facilities from all
hazards, in, upon, under and over the road hereinbefore des-
cribed to be abandoned by said County of Contra Costa.
PASSED AND ADOPTED on April 7, 1964, by the following vote:
AYES : Supervisors - James F. Kenny, Mel F. Nielsen, Thomas
John Coll, Edmund A. Linscheid, Joseph S. Silva.
NOES: Supervisors - None.
ABSENT: Supervisors - None.
