HomeMy WebLinkAboutRESOLUTIONS - 10172007 - CHECKME (122) IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA RESOLUTION NO. 2932 WHEREAS this Board of Supervisors has carefully con- sidered adoption of a policy regarding recovery of employer's costs resulting from job incurred injuries to employees when it is determined that there is third person liability; NOW, THEREFORE, BE IT BY THIS BOARD RESOLVED THAT: 1 . The Office of the District Attorney is authorized to review employee job incurred injury reports involving third persons and to exercise his discretion in determining whether there is liability on the part of the third person; 2. If it appears there is liability of a third per- son, the Office of the District Attorney shall ascertain whether the County shall initiate action in its own name or file an application for an employer's lien in an action brought by the employee through his own attorney; 3. If the County is to file an application for an employer' s lien, the Office of the District Attorne is author- ized to negotiate the fee (not to exceed 25 percent payable under California Labor Code, Section 3860. PASSED AND ADOPTED this 14th day of April, 1964, by the following vote: AYES: Supervisors James P. Kenny, Mel F. Nielsen, Thomas John Coll, Joseph S. Silva, Edmund A. Linscheid. NOES: None.
