HomeMy WebLinkAboutRESOLUTIONS - 10172007 - CHECKME (88) IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Claim of Contra Costa County against Clara Brummer RESOLUTION NO. 291-7— individually and as Conservatee; Allie V. Zarback, individually and RESOLUTION AUTHORIZING as conservator and Standard SUITS AND RATIFYING Accident Insurance Company, a PETITION FOR ORDER corporation. DIRECTING PAYMENT OF CLAIM The Board of Supervisors of Contra Costa County RESOLVES THAT: WHEREAS Clara Brummer has, since September, 1962 been in- debted to Contra Costa County in the sum of $1.953. 60 for hospital services . WHEREAS in Action No. 28784 in the Contra Costa County Superior Court , Allie V. Zarback was appointed conservator of the person and estate of Clara Brummer, upon a bond executed by the Standard Accident Insurance Company, with notice of the aforesaid debt . WHEREAS such conservatorship has received $19,662.6'7 and disbursed $17,'728.95 paying only $200.00 on account of said in- debtedness., ' .e ability of the conservatorship to pay the said in- debtedness is uncertain and an Accounting and Petition for Dis- charr;e of uch conservatorship have been filed for hearing; on April 2.1, 1964. NOW, THEREFORE, IT IS RESOLVED as follows: That the action of the District Attorney, in making and filinr6 on April 10, 1964 insaid Action 28784 a Petition for Order Directing Payment of Claim, be, and the same hereby is approved, ratified and affirmed. The District Attorney is authorized to file suit against Clara Brummer individually and/or as conservatee to recover the sum of $1,753.60, plus attorney fees, costs and punitive or exemplary dama'-es . The District Attorney is authorized to file suit against Allie V. Zarbak individually and/or as conservator to recover the sum of $1,'153.60, plus attorney fees, costs, and punitivee6xemplary damages. Ti:e District Attorney is authorized to file suit against Standard Accident Insurance Company upon the Bond in Action No. 28,84 to recover the sum of $1,753.60 plus attorney fees and costs . RESOLUTION NO. 2917 2 The District Attorney is authorized to file Objections and Exceptions to the First and Final Account , Petition for Fees and Commissions and Petition for Discharge on file in said Action No. 28784. PASSED AND ADOPTED on April 14, l9b4 by the following; vote: AYES: Supervisors - James P. Kenny, Mel F. Nielsen, Thomas John Coll, Joseph S. Silva, Edmund A. Linscheid, NOES: Supervisors - None.
