HomeMy WebLinkAboutRESOLUTIONS - 01012005 - 2005-581 i� ;IN THE MATTER OF RESOLUTION NO. 2005/581 PROTECTING THE RIGHTS OF CONTRA COSTA RESIDENTS WHEREAS, Contra Costa County recognizes the Constitution of the United States of America to be the supreme law of the land and all elected officials are sworn to uphold the Constitution of the United States of America and the State of California in discharging their duties;and WHEREAS, Contra Costa County is home to a diverse population, including citizens from other nations, whose contributions to the community are significant and important to all; and it is in the purview of local government to ensurethe protection of the rights of all Contra Costa County residents. Any weakening of those rights threatens the broad range of political expression that is vital to our democracy at the local,state, anc.f.deral'lelvels;.and,, . WHEREAS, the First Amendment of the,U iited State's Constitution states that Congress shall make no law respecting an stablishine t.of religion,or prohibiting the-£ree,.e excise thereof;or abridging the freedom of'sp' h, ot"of th,­e press,of thetighti of the pe6 'peaceabl :to assemble,and to petition the govei°mnent fora redress of grievances;and WHEREAS, the Fourteenth Amendment of the United States Constitution provid ,for equal protection of allpeople and prevents discrimination on,the.basis of race,religion;or ethhf'eity;and WHEREAS,the California Constitutional right to privacy;preverlts go exnment sufveillance of First Amendmentprotected activity in the absence of reasonable suspiOn cif a critrte` NOW,THEREFORE, BE IT RESOLVED, that the Board of Sppei�+ rs o Centra Qosta County shall urge.the Cc�ztra Costa sheriff's Depattret tc�prolaihtt all �bers ,f the department, including the J.oit Terrorism Task Force ("JTTF'i)a Froin hsing ta `e;etlinicty,country of origin, or religion as a fa& i I quesutst rig or intervietiving individuals without there.being a specific suspect desc iptioia'that, des such. factor,and FURTHER.BE IT RESOLVED, that the Board of Sll:nrge tie Contra Costa Sheriff's Department.to prohibit all ineinbers or the.lJepai:ti.xent i cludirig those parttct ating in the Joint Terrorism Task Force ("JTTF"),Froin inorlitoriiig or ccillfingin£rrmatton tti`individuals'and organizations part sips .in first+Amen tl gdirient prc tected'activity in fire absence of reasonable suspicion of a crime; and FURTHER BE ITRESOLVED. that the Board of Supervisors shall:hold 4nnual public hearings starting the fourth quarter of 2005 to review the County's:funding,1,of and participation on the Joint Terrorism Task Force and the;Contta Costa:Courzty Sheriff's Department's Homeland Security Unit (or otherwise renamed titiit)anis,tlisy shall.s rlictt ptit lic comment and input regarding anti- terrorisin efforts and activities in th 'county.
