HomeMy WebLinkAboutRESOLUTIONS - 10052004 - 2004-503 THE BOARD OF SUPERVISORS OFCONTRA COSTA COUNTY, STATE OF CALIFORNIA ADOPTED this resolution by the following vete: APES: SUPERVISORS GIOIA, UILKEMA, GREENBERG, GLOVER AND DESAULNIER NOES: NONE ABSENT: NONE ABSTAIN: NONE RESOLUTION NO. 2004/503 SUBJECT: Camra Costa County Initiated } General Plan Amendment } Boundary Adjustment to Urban Limit Line Map } To Make the Map Coterminous or Coincident With Existing City Limits } County File: GP#04-0005 } The Board of Supervisors of Contra Costa County RESOLVES that: WHEREAS, there is filed with the Board of Supervisors and its Clerk a copy of Resolution No. 28-2004 adopted by the Contra Costa County Planning Commission which discusses and recommends the Beard of Supervisors adopt the General Plan Amendment to make the County's Urban Limit Line boundary coterminous or coincident with the current incorporated city limit boundaries at various locations where it now intrudes inside those incorporated boundaries (County File: GP# 04-0005). WHEREAS, on Tuesday, October 5, 2004, the Board of Supervisors held a public hearing on said General Plan Amendment described in Contra Costa County Planning Commission Resolution No. 28-2004. Notice of said hearing was duly given in the manner required by law. The Board at a hearing, called for testimony of all persons interested in this matter. WHEREAS, on Tuesday, October 5, 2004, after closing the public hearing this Board ADOPTED a Legative declaration of Environmental Significance that the general Plan Amendment (County File: GP#04-0005) would not result in a significant impact on the environment, determined that the environmental review conducted is adequate for consideration of this General Plan Amendment, and directed the Community Development Department to file the Notice of Determination for the Negative Declaration. WHEREAS, the Board members having fully considered this amendment discussed in Contra Costa County Planning Commission Resolution No. 28-2004, the analysis and recommendations included in the Staff Report and Recommendations to the County Planning Commission, dated September 14, 2004, the Negative Declaration of Environmental Significance and CEQA Initial Study/Checklist prepared for this project, and the public testimony and written comments received at or submitted prior to the Board's public hearing on October 5, 2004, determines to amend the Contra Costa County General Plan, 1095-2010, modifying the boundary of the Urban Limit Line Map to mare the map coterminous or coincident with the existing city limit boundaries at various locations where it intruded inside these incorporated boundaries, as generally illustrated in the map attached as Exhibit "A" to this resolution. WHEREAS, the Board members have determined based on the criteria and factors for establishing the Urban Limit Line as set forth under Contra Costa County Ordinance Code Section 82-1.010, and under County Ordinance Cade Section 82-1.018 relating to changes to the Urban Limit Line, and more specifically under County Ordinance Code Section 82-1.018(4), that a minor change to the Urban Limit Line will more accurately reflect topographical characteristics or legal boundaries — in this case the change is necessary to reflect the location of the County's Urban Limit Line in relation to legally established municipal boundaries IT IS FURTHER RESOLVED, the Board determines to adopt this General Plan Amendment (County File: GP#04-0005) as the second of four consolidated amendments for 2004 to the mandatary elements of the Contra Costa County General Plan, 1995-2010, as permitted by State Planning Law. { hereby certify that the foregoing is a true and Contact.
