(District E) The Public Works Director has notified this Board that the private improvements (Molly Way)in Subdivision 8500 and the widening of Boulevard Way have been completed as provided in the Subdivision Agreement with Tamarind Place Associates,heretofore approved by this Board in conjunction with the filing of the Subdivision Map. (District II) DATE: December 9, 2003 PAGE: 2 BE IT FURTHER RESOLVED the payment(labor and materials) surety for$138,250.00, Bond No. 8781995 issued by the above surety be RETAINED for the six month lien guarantee period until June 9, 2004, at which time the Clerk of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the private improvements have been COMPLETED and the roads are NOT ACCEPTED NOR DECLARED as County roads at this time. BE IT FURTHER RESOLVED that the widening of Boulevard Way is ACCEPTED and DECLARED to be a County road,the right-of-way was conveyed by separate instrument,recorded on May 17, 2002 , in Book 442 of Maps on Page 37. BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and the$2,765.00 cash deposit(Auditor's Deposit Permit No. 382224,dated February 27, 2002) made by Desco Development Company and the performance/maintenance surety for $273,735.00, Bond No. 8781995 issued by Developers Surety and Indemnity Company be RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code until release by this Board.
