Dept: Public Forks(Mic) Cc: Public Works Accounting Auditor Tax Collector Assessor RESOLUTION O. 99/ 440 PUBLIC WORKS DEPARTMENT CONTRA COSTA COUNTY DATE. September 14, 1999 TO: Board of Supervisors FROM: J. Michael Wilford, Public Works Dir t SUBJECT: Report on Sidewalk Hazard Abatement at 234 Norman Avenue, Clyde Area. This report is in reference to the September 14, 1999 Hearing on the confirmation of the sidewalk repair cost for the hazard abatement at 234 Norman Avenue, Clyde Area. In April of 1997, we became aware through field survey of sidewalk hazards fronting 234 Norman Avenue. Our Department notified Carl and Toni Mattingly and one other property owner in the area that the sidewalk in front of their home was in disrepair and required replacement. In these cases, the sidewalk was badly cracked and broken, was a hazard to the public and presented the County with a liability problem if left unrepaired. In accordance with the Streets and Highways Code of the State of California, it is the responsibility of the property owner to maintain the sidewalk fronting their property in a safe condition. Since our initial notifications in 1997, Mr. and Mrs. Mattingly failed to comply with our request to replace the hazardous sidewalk. We give property owners ample opportunity to replace their sidewalks since it's usually less expensive for them to arrange for the work. We sent numerous notices to this property owner in the hope of eventual compliance. When it finally appeared that the sidewalk was not going to be repaired, we requested bids from licensed contractors to make the repairs. The lowest qualified bidder was selected to complete the repairs after proper notification and posting of the property. We have billed the Mattinglys for $1,592.28, which represents the total cost of the repairs, including administrative costs, as allowed by the Streets and Highways Code. Since Mr. And Mrs. Mattingly ha,,e not paid their bill after many attempts of collection, we recommend that the cost of repair together with a property tax roll collection fee of$250.76 be assessed against their property as a lien. jMW:3M:pc G:\GtpData\ Maint\Pats\1499\ Board OrderaNattinglyhearine-99.doc cc: P.Batchelor,Co.Admin.
