RESOLUTION NO. 99/4 3 8
PUBLIC WORKS DEPARTMENT
CONTRA COSTA COUNTY
DATE: August 31, 1999
TO: Board of Supervisors
FROM: J. N ichael Walford, Public Works Direc
SUBJECT: Report on Sidewalk Hazard Abatement at 10 Canal Drive, Baypoint Area.
This report is in reference to the September 14, 1999 Hearing on the confirmation of the sidewalk
repair cost for the hazard abatement at 10 Canal Drive, Baypoint Area.
In April of 1997, we became aware through field survey of sidewalk hazards fronting 10 Canal Drive.
Our Department notified numerous property owners in the area that the sidewalks in front of their
homes were in disrepair and required replacement. In these cases, the sidewalks were badly cracked
and broken, were a hazard to the public and presented the County with a liability problem if left
unrepaired. Among the property owners notified was Home Beneficial owning property at 10 Canal
Drive. In accordance with the Streets and Highways Code of the State of California, it is the
responsibility of the property owner to maintain the sidewalk fronting their property in a safe
condition.
Since our initial notifications in 1997, all of the property owners we contacted complied with our
request to replace their hazardous sidewalks, with the exception of Horne Beneficial. We give
property owners ample opportunity to replace their sidewalks since it's usually less expensive for
them to arrange for the work. We sent numerous notices to this property owner with the hope of
eventual compliance. When it appeared that Home Beneficial was not going to repair the sidewalk,
we requested bids from licensed contractors to make the repairs. The lowest qualified bidder was
selected to complete the repairs after proper notification and posting of the property.
We have billed Home Beneficial for $960.50, which represents the total cost of the repairs, including
administrative costs, as allowed by the Streets and Highways Code. Since Home Beneficial has not
pard their bill after many attempts of collection, we recommend that the cost of repair together with
a property tax roll collection fee of$250.76 be assessed against their property as a lien.
