Walchek and K.elli A. Walchek, as Trustees of the Walchek Family Revocable Trust dated November 19, 1998, declare the following: a. We are the owners of Lot 30, Subdivision 6885, located at 295 Barrington Lane, Alamo, California, as described in the Deed to us, recorded December 10, 1998, in Series 98-0310401-00 of Official Records of Contra Costa County, California (the "Property"). b. We have applied for a building permit to replace a damaged swimming pool and to construct related patio, out buildings and retaining walls. C. In consideration of and as a condition to the granting of the permit referred to in subparagraph(b)above,we agree to construct said described improvements in accordance with the conditions of that permit. d. In further consideration of the granting of said building permit, we hereby release the County of Contra Costa and the Contra Costa County Flood Control District,their respective officers, agents and employees from any claim, cost or liability arising out of, or in connection with, any damage to the site or any new or existing improvements,resulting from the construction allowed under said building permit. e.
