The Board of Supervisors of Contra Costa County Resolves that:
The Public Works Director(the County Surveyor) has filed with this Board a report specifying
that sidewalk and related curb repairs have been made adjoining the real property (APN 035-113-024)
located at 111 Acme West Street, (Oakley area), costing $2,432.94 (including property tax roll collection
fee) proposing that this sum be assessed and levied against the said parcel of real property, and indicating
that timely notice of a hearing on this date (at 9 a.m.) before this Board was provided to the real property
owner's Manuel and Gracie Cornelius in the manner required by law.
At the time fixed for hearing on this date, this board heard the report of the Public Works Director and
any objections or protests by the involved property owners and other interested persons and closed the
hearing.
This Board Hereby finds, determines, confirms and orders that:
1. It has considered and passed upon the Public Works Director's report and any objections or
protests made.
2. The said report is confirmed and the sum of$2,432.94 is assessed and levied against the
parcel of real property (APN 035-113-024) located at 111 Acme West Street, Oakley, CA. 94561.
1 hereby certify that this is a true and correct copy of an action taken and
entered on the minutes of the Board of Supervisors on the date shown.

3. If the above specified assessed sum is not paid within five (5) days of this date to the County,
it shall constitute a special assessment against said parcel of property, and shall be a lien thereon
(together with administrative fees, interest, and penalties due) until it is paid, or until it is discharged of
record.
4. The Public Works Director shall cause a notice of lien for the above specified and unpaid
assessment lien to be prepared and completed pursuant to Streets and highways Code section 5626 and;
a. Delivered to and filed for recordation in the County recorder's office a completed and
executed original copy of said notice of lien, and
b. Turn over completed copies of the said notice of lien to the County Assessor, Auditor
and tax Collector for tax roll collection pursuant to Street and highways Code Section 5628 and 5629.
5. Upon completed payment of the assessment (including any administrative fees, penalties and
interest due thereon), the Public Works Director is authorized on behalf of the County to execute any
necessary and appropriate release or satisfaction of lien proposed by the involved landowners.

SUBJECT: Report on Sidewalk Hazard Abatement at. Street, Oakley Area

This report is in reference to the August 10, 1999 Hearing on the confirmation of the sidewalk repair
cost for the hazard abatement at 111 Acme West Street, in the Oakley area.
In late 1995, we became aware through citizen complaints and field surveys of sidewalk problems
in the Oakley area. Since December of 1995, our Department notified approximately 20 residents
in the Oakley area that the aging sidewalks in front of their homes were in disrepair and required
replacement. In many cases, the sidewalks were badly cracked and broken, were a hazard to the
publ;c and presented the County with a liability problem if left unrepaired. Among the residents
notified were Manuel and Gracie Cornelius owning the property at 111 Acme West Street. In
accordance with the Streets and highways Code of the State of California, it is the responsibility of
the property owner to maintain the sidewalk fronting their property in a safe condition.
Since our initial notifications in 1995, all of the residents we contacted have complied with our
request to replace their hazardous sidewalks with the exception of the Cornelius'. Normally, we give
the property owners ample opportunity to replace their sidewalks since it's usually less expensive
for.them to arrange for the work. Since late 1995, we have sent numerous notices to these property
owners with the hope of eventual compliance. When the Cornelius' failed to replace their sidewalk,
we asain sent follow up letters in 1996 and posted their property in accordance with the Streets and
Highways Code. After it became apparent that the sidewalk was not going to be repaired, our
Mair.enance forces completed the sidewalk repair in October of 1996.
We have billed the Cornelius' for $2,182.18 which represents our cost to repair the sidewalk, as
allowed by the Streets and Highways Code. Since the Cornelius' have not paid their bill after many
attempts of collection, we recommend that the cost of repair together with a property tax roll
collection fee of$250.76 be assessed against the their property as a lien.
