HomeMy WebLinkAboutRESOLUTIONS - 10211997 - 97-601 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on , by the following vote: AYES: SUPERVISORS ROGERS, UILKEMA, GERBER, CANCIAMILLA and DeSAULNIER NOES: NONE ABSENT: NONE ABSTAIN: NONE SUBJECT: Confirmation of ) Resolution No 97/601 Sidewalk Repair ) (S. &H.C. § § 5618, 5626 & 5628) Costs, for Hazard Abatement at: ) 4151 Miflin Court, ) El Sobrante Area ) APN 420- 031-032 ) The Board of Supervisors of Contra Costa County Resolves that: The Public Works Director(the County Surveyor)has filed with this Board a report specifying that sidewalk and related curb repairs have been made adjoining the real property(APN 420-031- 032) located at 4151 Miflin Ct., (El Sobrante area), costing $4,720.00 (including property tax roll collection fee)proposing that this sum be assessed and levied against the said parcel of real property, and indicating that timely notice of a hearing on this date(at 2 p.m.) before this Board was provided to the real property owners (Wendell and Mary Harper) in the manner required by law. At the time fixed for hearing on this date, this Board heard the report of the Public Works Director and any objections or protests by the involved property owners and other interested persons and closed the hearing. This Board Hereby finds, determines, confirms and orders that: 1. It has considered the Public Works Director's report and any objections or protests made. 2. The Board determined that the sum of$4,470.00 is assessed and levied against the parcel of real property (APN 420-031-032) located at 4151 Miflin Court, El Sobrante. 3. The above specified assessed sum shall constitute a special assessment against said parcel of property, and shall be a lien thereon until it is paid, or until it is discharged of record. 4. The Board acknowledged Mr. Harper's agreement to pay the assessment lien amount of$4,470.00 in 36 monthly installment payments together with compound interest thereon at an annual percentage rate of 5.31 percent. 5. The Board directed the Public Works Department to prepare an agreement and authorized the Public Works Director to execute said agreement with Mr. and Mrs. Harper providing for the installment payment of the assessment lien as above described. 6. The Public Works Director shall cause a notice of lien for the above specified and unpaid lien to be prepared and completed pursuant to the Streets and Highways Code Section 5625 and delivered to and filed for recordation in the County Recorder's Office a completed and executed original copy of said notice of lien. 7. Upon completed payment of the assessment(including any administrative fees, penalties and interest due thereon), the Public Works Director is authorized on behalf of the County to execute any necessary and appropriate release or satisfaction of lien proposed by the involved landowners.
