HomeMy WebLinkAboutRESOLUTIONS - 10141997 - 97-537 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 14 , 1997 by the following vote: AYES: Supervisors Rogers, Uilkema, Gerber, Canciamilla, and DeSaulnier NOES: None ABSENT: None ABSTAIN: None SUBJECT: IN THE MATTER OF TRANSFERRING ) SMALL CLAIMS ADVISOR PROGRAM ) Resolution No. 97/537 FROM COUNTY COUNSEL TO THE ) COORDINATED TRIAL COURTS ) Upon the recommendation of the County Administrator, County Counsel, and the Executive Officer of the Contra Costa County Coordinated Trial Courts, pursuant to Code of Civil Procedure section 116.940, it is by the Board ordered: The small claims advisory service of Contra Costa County is transferred from the County Counsel to the Contra Costa County Coordinated Trial Courts effective November 1, 1997. As transferred, the small claims program shall have the following characteristics: 1. The service shall be operated in compliance with the requirements of Code of Civil Procedure section 116.940. 2. In addition to the minimum components required by law, the Program will include a combination of some or all of the following program components, as determined by the Coordinated Trial Courts. The Program may include individual meetings with litigants multiple times each month at the following court sites: Bay Court in Richmond, Delta Court in Pittsburg, Mt. Diablo Court in Concord, and Walnut Creek-Danville Court in Walnut Creek. The Program may include as reasonably determined by the Coordinated Trial Courts, recorded telephone messages to supplement the individual personal advisory services being provided. The Program also may include development and ongoing maintenance of an Internet Webpage (either in conjunction with the existing CCC Coordinated Courts Website or in conjunction with other county court Websites). The Small Claims Advisor may also provide services to litigants of a more general nature, such as developing written materials and brochures for general dissemination to litigants, and presenting seminars on commonly faced problems to groups of litigants. The Small Claims Advisor may also be called upon to prepare,train and supervise volunteers, students, or others to assist in the presentation of the broadest range of services as possible. 3. The Program services may be provided by an independent contractor consistent with standards for the Program contractually set by the Coordinated Trial Courts. The Program will provide individual personal advisory services, either in person or by telephone, as well as by any other means reasonably calculated to provide timely and appropriate assistance to small claims litigants. 4. The Contra Costa County Coordinated Trial Courts Executive Officer is authorized to contract for such small claims advisory services as may be approved by the Coordinated Trial Courts, and otherwise to operate the program within such limits as exist for the funding for such services pursuant to Code of Civil Procedure section 116.910.
