THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this order on October 7, 1997 by the following vote:

SUBJECT
In the Matter of Confirming Benefit Levels
for Exempt Court Employees Res. No. 97/ 524
Designated employees and Judicial Officers of the Court are exempted from the County
Merit System (County Ordinance Code Section 33-5.349) and are governed separately in
their terms and conditions of employment by authority of California Rules of Court, Rule No.
207. Pursuant to Standards of Judicial Administration Sec. 27 the Court administers an
approved personnel plan for Court appointed employees that provides for wage and job
classification, employee benefit plan, recruitment, selection, training, promotion, discipline,
and removal of employees of the court.
By direction of the Court, the salary and benefit levels of Court employees, if not
established specifically by the State, have generally conformed to those represented,
unrepresented and management classes in the County merit system whose duties and
responsibilities are similar; except that certain Court classes have been differentiated from
their merit system counterparts in type of benefits provided. These differences have
created on-going administrative difficulties and require clarification.
The Coordinated Trial Courts recently implemented a new classification plan for exempt
management classes and these changes are reflected in this new resolution.
Therefore, in order to confirm the direction of the Court as to the level of benefits for its
various employees and to establish the necessary administrative record by which benefits
are granted, the Contra Costa County Board of Supervisors in its capacity as governing
Board of the County of Contra Costa, and all districts of which it is the ex officio governing
Board, RESOLVES THAT:
A. The class of Executive Officer-Coordinated Trial Courts of Contra Costa County
2AA2 has been designated as management-exempt [CF04(B)/CF05(BH)j and
eligible to those general benefits available to all merit system management
employees such as those set forth in Resolution 96/488 Compensation and Benefits
for County Officers, Managers and Unrepresented Employees. Additionally, this
single position is eligible to receive all benefits provided Department Heads.
Exception: Exempt Court management positions shall be credited with eight (8)
hours of paid holiday time on January 1, 1997 and January 1 thereafter. Cost of
Living increases for this position are linked to that of the class of Superior Court
Judge.

B. The class of Assistant Executive Officer- Coordinated Trial Courts (SAB4) has been
designated as management-exempt [CF04 (8)/CF05(BC)] and eligible to those
general benefits available to all merit system management employees such as those
set forth in Resolution 96/488 Compensation and Benefits for County Officers,
Managers and Unrepresented Employees. Additionally, this position is eligible to
receive all benefits provided to chief assistants specifically including professional
development reimbursement in the amount of $750 for each two (2) year period
beginning January 1, 1997. Exception: Exempt Court management positions shall
be credited with eight (8)hours of paid holiday time on January 1, 1997 and January
1 thereafter.
C. The following Court classes which have been designated as management-exempt
[CF04(B)/CF05(BC)] are eligible to those general benefits available to all merit
system management employees such as those set forth in Resolution 96/488
Compensation and Benefits for County Officers, Managers and Unrepresented
Employees. Exception: Exempt Court management positions shall be credited with
eight (8) hours of paid holiday time on January 1, 1997 and January 1 thereafter.

D. The following Court non-management clerical classes which have been designated
as unrepresented and exempt [CF04(F)/CFO5(FC)] and are deemed sufficiently
similar to comparable levels in the Clerical Deep Class represented by AFSCME
Local 2700 to receive the same benefits as are granted Local 2700 employees.
Exception: Exempt Court non-management clerical positions shall be credited with
eight (8) hours of paid holiday time on January 1, 1997 and January 1 thereafter.

E. The following Court classifications are designated as unrepresented-exempt
[CF04(5)/CFO5(FD)] and shall continue to receive those general benefits such as
sick leave accruals, group medical/dental insurance and membership in the County
Retirement System, and the annual Video Display Terminal Users eye examination.
Exception: Exempt Court non-management unrepresented positions shall be
credited with eight (8) hours of paid holiday time on January 1, 1997 and January
1 thereafter. Additionally these classes will accrue vacation as follows:

(*The class of Assistant Secretary to the Superior Court Judges J3T2 is designated
as unrepresented-exempt. This class will receive those benefits afforded to other
Court exempt unrepresented classes as noted in F above. This class will also
continue to receive management benefits and allowances as set forth in resolution
92/107 only; except this class will receive Management Life Insurance benefits
coverage of $47,000 as provided by resolution 96/488 section IV J adopted
November 19, 1996. At the time the current incumbent vacates this position, this
class will be provided only those benefits afforded exempt Court unrepresented
classes.)
F. The following Court Judicial Officer classes whose salaries are related to the salary
of Superior Court Judge and who have been designated as management-exempt
[CFO4(B)/CF05(BJ)] are eligible to sick leave accruals, .group medical/dental
insurance and membership in the County Retirement System, management benefits
including life insurance, deferred compensation incentive, long term disability, and
sick leave incentive. These classes are not eligible to the following management
benefits: VDT users eye examination, Catastrophic Leave Bank, management
longevity pay differential, personal floating holiday accruals, management
administrative leave and management vacation accruals. These classes are
eligible to 168 hours vacation to be credited January 1, 1997 and January 1
thereafter. This time is non-accruable and all balances will be zeroed out effective
December 31 st each year.

G. The Court classes of Court Reporter-Superior Court JPS1 and Chief Court Reporter-
Superior Court 2BT1 are designated as unrepresented-exempt [CF04 (F)/CF05(FR)]
and are subject to terms of employment, including benefits, in accordance with
Rules of the Superior Court adopted by the Court on February 1, 1993 and further
amendments. (Rules for Superior Court Reporters). The vacation and sick leave
accruals afforded the Court reporter classes will be zeroed out at time of termination
or retirement. Court reporter classes shall continue to receive those general
benefits such as group medical/dental insurance and membership in the County
Retirement System.
H. The class of Judge, Superior Court-Group III (2RA1) [CF04(A)/CF05(AJ)] has been
designated as management- exempt and are eligible to receive those benefits
afforded all department heads. As appropriate some benefits such as long term
disability may be prorated based on the county portion of the judicial salary.
I. The following exempt Court classes designated as non-management
unrepresented, are members of the Superior Court S.D.I. (State Disability
Insurance) unit, and are therefore eligible to participant benefits:
