SUBJECT: In the Matter of Early Retirement RESOLUTION NO. 964_499
The Board of Supervisors of Contra Costa County RESOLVES THAT:
I. By Ordinance 76-83, the Board of Supervisors has adopted the provisions of Government Code Section
31641.04, permitting early retirement service credit.
II. The Growth Management and Economic Development Agency (GMEDA) continues to reorganize and
consolidate its senior supervisory staff by seeking elimination of two Principal Planner positions, or their
equivalents, within the Community Development Department.
.III. The resultant effect within the GMEDA and Department will be a more conventional hierarchy of top
administration and supervisory planners to that of the operational planner series below them; it will allow
salary and benefit savings of approximately$90,000 annually per position. The best interests of the County
will be served by permitting additional service credit for certain members of the Contra Costa County
Employees Retirement Association (members) as follows:
a. The provisions of this resolution are applicable to all members employed in the job classification of
Principal Planner-Level B (Class Code 5AHE) on November 6, 1996 (eligible members).
b. Every eligible member who retires during the two periods of November 6, 1996 to December 31, 1996
and March 30, 1996 to June 30, 1997 shall receive two additional years of service credit for Contra
Costa County service, provided that an eligible member agreeing to retire during the first period shall
submit a letter of retirement by November 6, 1996 and an eligible member agreeing to retire during the
second period shall submit a letter of retirement no later than March 17, 1997.
c. Upon demand by the Retirement Association, the County Auditor-Controller shall transmit to the
Retirement Fund the amount(s) determined by the Retirement Association to be the actuarial equivalent
of the difference between the allowance the eligible member receives after getting the additional service
credit hereunder and the allowance he/she would have received without such credit.
d. On later reentry into County employment under circumstances otherwise requiring or permitting
membership in the retirement system, any member who has received additional service hereunder shall
forfeit such additional service credit, and the County's payments hereunder shall be refunded, unless the
reentry is the result of a temporary call-back limited to a minimum of 960 hours of service in any one
calendar year.
e. Provided, nevertheless, that the provisions of this Resolution are not acceptable
1. To any member otherwise eligible if such member received any unemployment insurance payment
within six months prior to November 6, 1996.
2. To any member if the member is not eligible to retire without additional service credit under this
Resolution.
PASSED by the following vote of the Board of Supervisors on the 5th day of November, 1996:
AYES: Supervisors Rogers, De Saulnier, Torlakson and Smith
NOES: None
ABSENT: None
ABSTAIN: Supervisor Bishop
