SUBJECT: RESOLUTION ELECTING TO BE SUBJECT TO PUBLIC EMPLOYEES'
MEDICAL AND HOSPITAL CARE ACT ONLY WITH RESPECT TO
EMPLOYEES REPRESENTED BY THE UNITED PROFESSIONAL
FIREFIGHTERS IAFF LOCAL #1230, A RECOGNIZED EMPLOYEE
ORGANIZATION
AND
FIXING THE EMPLOYER'S CONTRIBUTION AT AN AMOUNT GREATER
THAN THAT PRESCRIBED BY SECTION 22825 OF THE GOVERNMENT
CODE
WHEREAS: (1) The Contra Costa County Board of Supervisors is the
ex officio governing body of the Contra Costa
County Fire Protection District and adopts this
resolution in that capacity; and
WHEREAS: (2) Government Code Section 22850. 3 provides that a
contracting agency may elect upon proper
application to participate under the Public
Employees' Medical and Hospital Care Act with
respect to a recognized employee organization only;
and
WHEREAS: (3) Government Code Section 22754 (g) defines a county
or special district subject to the County Employees'
Retirement Law of 1937 as a contracting agency; and
WHEREAS: (4) Contra Costa County Fire Protection District is a
special district subject to the County Employees'
Retirement Law of 1937 and desires to obtain for
certain of its employees and retired employees the
benefit of the Act and to accept the liabilities
and obligations of an employer under the Act and
Regulations; and
WHEREAS: (5) Contra Costa County Fire Protection District
desires to obtain for its employees who are
represented by the United Professional Firefighters
IAFF Local #1230 and the counterpart retirees and
retiree survivors, the benefits of the Act and to
accept the liabilities and obligations of an
employer under the Act and Regulations; now,
therefore, be it
RESOLVED (a) That the Contra Costa County Fire Protection
District elects to be subject to the Act; and be it
further
RESOLVED (b) That the employers's contribution for each employee
or annuitant shall be the amount necessary to pay
the full cost of his/her enrollment, including the
enrollment of family members, in a health benefits
plan or plans up to a maximum of $115.96 with
respect to employees or annuitants enrolled for
self alone, $231.92 for self and one family member,
and $301. 50 for self and two or more family members
plus administrative fees and Contingency Reserve
Fund assessments; and be it further
RESOLVED (c) That the executive body appoints and directs Leslie
T. Knight, Director of Human Resources, or her
designated representative, to file with the Board
of Administration of the Public Employees'
Retirement System a verified copy of this
Resoluton, and to perform on behalf of this special
district all functions required of them under the
Act and regulations of the Board of
Administration; and be it further
RESOLVED (d) That coverage under the Act be effective
January 1, 1997.
