RESOLUTION NO.96/480
SUBJECT: Approve amendment to September 24, 1996 board order for completion of improvements,
and declaring certain roads as County roads and approve a subdivision agreement (for
maintenance period), Minor Subdivision 86-88, Oakley area.
The Public Works Director having notified this Board that the improvements for minor subdivision
86-88, being developed by Fred D. Lorenzetti, have been completed and that such improvements have
been constructed without the need for a subdivision agreement;
NOW THEREFORE BE IT RESOLVED that the improvements in the above-named development
have been COMPLETED as of this date July 8, 1996 thereby establishing the six-month terminal period
for filing of liens in case action under a subdivision agreement for the maintenance period only.
BE IT FURTHER RESOLVED that the widening of Mellowood Drive(formerly know as Carla
Drive)is ACCEPTED and DECLARED to be a County Road;the right of way was conveyed by separate
instrument,recorded on December 7, 1981, in Volume 10601 of Official Records on page 173.
BE IT FURTHER RESOLVED that the beginning of the one year warranty period is hereby
established,and the$1,000 cash deposit(Auditor's Deposit Permit No. 281179, dated July 18, 1996)made
by Fred D. &Linda A. Lorenzetti be RETAINED for one year pursuant to the requirements of Section
94-4.406 of the Ordinance Code.

The following document was presented for Board approval this date:
A. A subdivision agreement with Fred D. Lorenzetti, subdivider, whereby said subdivider
guaranties performance of constructed improvements for the maintenance period.
B. Said document was accompanied by a corporate surety bond dated September 3, 1996,
and issued by Surety Company of the Pacific (Bond No. M 102139) with Fred D.
Lorenzetti as principal,in the amount of$5,795 for faithful performance and$22,650 for
labor and materials.
NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its
design and improvement, is DETERMINED to be consistent with County's general and specific plans;
BE IT FURTHER RESOLVED that said Subdivision Agreement(for labor and materials and the
maintenance period)is also APPROVED.
