THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on January 23, 1996 by the following vote:
AYES: SUPERVISORS ROGERS, BISHOP, DESAULNIER, TORLAKSON, SMITH

RESOLUTION NO. 962 Al
SUBJECT: Completion of Improvements, LUP 2036-92, Oakley Area.
The Public Works Director having notified this Board that the improvements for LUP
2036-92, being developed by Bridgehead Center Partnership, have been completed and that such
improvements have been constructed without the need for Drainage Improvement Agreement;
NOW THEREFORE BE IT RESOLVED that the improvements have been
COMPLETED as of January 10, 1996 thereby establishing the six-month terminal period for the
filing of liens in case of action.
BE IT FURTHER RESOLVED that$51,000 of the$117,964.95 cash security for labor
and materials (Auditor's Deposit Permit No. 234568, dated November 18, 1993) deposited by
Bridgehead Center Partnership be RETAINED for the six-month lien guarantee period until July
10,1996, at which time the Public Works Director is AUTHORIZED to refund the cash security
less the amount of any claims on file.
BE IT FURTHER RESOLVED that the beginning of the one year warranty period is
hereby established, and that $15,300 of the$117,964.95 cash deposit (Auditor's Deposit Permit
No. 234568, dated November 18, 1993) made by Bridgehead Center Partnership be RETAINED
for one year pursuant to the requirements of Section 94-4.406 of the Ordinance Code.

BE IT FURTHER RESOLVED that the Public Works Director is AUTHORIZED to
refund ($117,964.95 - $51,000 (6 month labor & material deposit) - $15,300 (1 year warranty
deposit) - $6,126.40 (balance due on inspection fee) = $45,538.55 of the $117,964.95 cash
security for performance(Auditor's Deposit Permit No. 234568, dated November 18, 1993) plus
interest in accordance with Government Code Section 53079, if appropriate, to Bridgehead Center
Partnership pursuant to the requirements of the Ordinance Code.
