HomeMy WebLinkAboutRESOLUTIONS - 11141995 - 95-554 ' C J Of THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 14, 1995 by the following vote: AYES: Supervisors Rogers, Smith, DeSaulnier, Torlakson, Bishop NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.:95/554 SUBJECT: Approval of the Final Map and Subdivision Agreement for Subdivision 7818, Alamo Area. The following documents were presented for Board approval this date: The Final Map of Subdivision 7818, property located in the Alamo area, said map having been certified by the proper officials; A Subdivision Agreement with Highland Builders, Inc. , subdivider, whereby said subdivider agrees to guarantee all improvements for one year. Said documents were accompanied by: I. Security to guarantee the warranty period (which began Octdber 10, 1995) of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 268030, dated October 12, 1995) in the amount of $8,000 made by Highland Builders, Inc.. B. Additional security in the form of a corporate surety bond dated October 9, 1995, and insured by United Pacific Insurance (Bond No. U2592726) with Highland Builders, Inc. as principal, in the amount of $112,570 for the one year warranty and $401 ,900 for labor and materials. I[. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1995-96 tax lien has been paid in full; This Board previously accepted the improvements for this subdivision as complete on October 10, 1995. NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of October 10, 1995 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT SURETY November 14, 1995 United Pacific Insurance Company Bond No. U2592726 BE IT FURTHER RESOLVED that Alamo Country Circle, Elliott Court, Harrington Court, Ensley Court, Osher Court, Neely Court, Young Court, Evelyn Court, Turner Court, and Gibson Court the hereinafter described roads, as shown and dedicated for public use on the Final Map of Subdivision 7818, are ACCEPTED and DECLARED to be County Roads. ROAD NAME ROAD/RIGHT OF WAY WIDTHS LENGTHS (MILES) Alamo Country Circle 32/52 .61' , Elliott Court 32/52 .08 Harrington Court 32/52 .08 Ensley Court 32/52 .04 Osher Court 32/52 .04 Neely Court 32/52 .04 Young Court 32/52 .06 Evelyn Court 32/52 .09 Turner Court 32/52 .04 Gibson Court 32/52 .02 NOVEMBER 14, 1995 APPROVAL OF THE FINAL MAP AND SUBDIVISION AGREEMENT FOR SUBDIVISION 7818, ALAMO AREA. PAGE TWO BE IT FURTHER RESOLVED that the widening of Livorna Road is ACCEPTED and DECLARE to be a County Road; the right of way was conveyed on the Final Map of Subdivision 7818. BE IT FURTHER RESOLVED that the beginning of the one year warranty period was previously established by this Board on October 10. 1995 and the $8,000 cash deposit (Auditor's Deposit Permit No. 268030 dated October 12, 1995) made by Highland Builders , Inc., be RETAINED for one year pursuant to the requirements of Section 94- 4.406 of the Ordinance Code. NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans; BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the paths or easements shown thereon as dedicated to public use. All deposit permits are on file with the Public Works Department. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED.
