HomeMy WebLinkAboutRESOLUTIONS - 11191991 - 91-750 Recording at the request of: Contra Costa County /1 2-0 Return to: / Public Works Department Records Section THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 19, 191 by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 91/91/7 50 SUBJECT: Completion of Improvements and Approval of the Road Improvement Agreement for Warranty, LUP 2030-90, Pacheco Area. The Public Works Director has notified this Board that the improvements for LUP 2030-90 have been completed and that such improvements have been constructed without the need for a Road Improvement Agreement, and that the following agreement for the warranty of the improvements is presented for Board approval: A Road Improvement Agreement for Warranty with Top Grade Construction, Incorporated, developer, whereby said developer agrees to warrant all improvements as required in said Road Improvement Agreement for Warranty within one year from the date of said agreement. Improvements generally consist of frontage improvements on Center Avenue. Said document was accompanied by the following: Security to guarantee the warranty of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 185352, dated February 4, 1991 in the amount of $1,000 made by J. M. O'Neil, Incorporated. B. Corporate surety bond dated December 28, 1990, and issued by St. Paul Guardian Insurance Company (Bond No. 400JB0373) with Top Grade Construction, Incorporated as principal, in the amount of$57,250 for faithful performance and$28,625 for labor and materials. NOW THEREFORE BE IT RESOLVED that the improvements in the above- named development have been COMPLETED as of September 3, 1991 thereby establishing the six-month terminal period for the filing of liens. BE IT FURTHER RESOLVED that said Road Improvement Agreement for Warranty is APPROVED. November 19, 1991 Page Two BE IT FURTHER RESOLVED that the beginning of the one year warranty period is hereby established as of September 3, 1991, and the aforesaid $1,000 cash deposit be RETAINED for one year pursuant to the requirements of Section 94-4.406 of the Ordinance Code.
