SUBJECT: Approving Clarification of Improvements Required by Deferred
Improvement Agreement along Willow Road and Sugar Barge Road
(Piper Road Extension) for LUP 2105-84,. Bethel Island Area.
On February 9, 1988, the Board authorized the Public Works
Director to execute a Deferred Improvement Agreement with Hilltop
Developers, Inc. for improvements along Willow Road and Sugar Barge Road
(Piper Road Extension) as required by the conditions of approval for LUP
2105-84.
The aforesaid Deferred Improvement Agreement was recorded on
February 12, 1988 -in Book 14168 of Official Records at page 73 and
became an encumbrance against Assessor's Parcel Nos. 030-120-017 and
030-170-026.
Also on February 9, 1988, the Board Accepted for recording
only, an offer of dedication for the rights- of- way for the roadway
improvements deferred under said agreement as required by the conditions
of approval for LUP 2105-84.
The aforesaid offer of dedication was recorded on February 24 ,
1988 in Book 14186 of official records at page 593 .
The Public Works Director now informs this Board that the
developer has requested that the scope of the road improvements required
by the Deferred Improvement. Agreement be clarified in light of the

requirements of the current CountGeneral Plan and Bethel Island
Specific Plan and other changed circumstances.
The Public Works Director having recommended that the
following. clarification be accepted:
1. Notwithstanding any language to the contrary in the Deferred
Improvement Agreement for LUP 2105-84, the improvements required under
the Deferred Improvement Agreement for the construction of Willow Road
through the property and the construction of Sugar Barge Road (Piper
Road extension) along the property shall be consistent with, and not in
excess of, the requirements specified in the County General Plan and the
Bethel Island Specific Plan in effect at the time the construction of
such improvements is required to commence pursuant to the Deferred
Improvement Agreement.
2. If the requirements of the County General Plan and the Bethel
Island Specific Plan in effect at the time of the commencement of such
construction specify right- of-' way of lesser dimensions than those
specified in the recorded Offer of Dedication, said excess right-of-way
shall thereupon be vacated by the County by a- termination of the offer
of dedication on the excess right-of-way.
