HomeMy WebLinkAboutRESOLUTIONS - 01081991 - 91-6 Recorded at therequest of: i, •� Contra Costa County Return to: Public Works Department Records Section THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on January 8, 1991 by the following vote: AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 91/6 SUBJECT: Completion of Improvements, Subdivision 7108, San Ramon Area. The Public Works Director having notified this Board that the improvements in Subdivision 7108 have been completed as provided in the Subdivision Agreement with Grupe Development Company-Northern California heretofore approved by this Board in conjunction with the filing of the Subdivision Map. The Public Works Director having further notified this Board that said subdivision has been annexed by the City of San Ramon, and that the County has continued to perform inspection services and perform routine staff duties in processing the subdivision until its completion as agreed to with the City, and that the City concurs , in accepting the improvements in said subdivision as complete. By accepting the improvements as complete, the County does not accept the roads for maintenance. The Public Works Director having also notified this Board that these improvements have been completed with the exception of minor deficiencies, for which the following document was presented for board approval. A Road Improvement Agreement with Grupe Development Company- Northern California, developer, whereby said developer agrees to complete all improvements as required in said Road Improvement Agreement within one year from the date of said agreement. Improvements generally consist of removal of all landscaping materials from the road right of way. Said document was accompanied by the following: Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: a. Cash deposit (Auditor' s Deposit Permit No. 183119 , dated December 14 , 1990) in the amount of $1, 000, made by The Grupe Company. b. Additional security in the form of: A corporate surety bond dated November 14 , and issued by American Motorists Insurance Company (Bond No. 3SM 762 015 00) with Grupe Development Company-Northern California as principal, in the amount of $9000 for faithful performance and $5, 000 for labor and materials. NOW THEREFORE BE IT RESOLVED that the aforementioned improvements have been ACCEPTED as complete as of October 2 , 1990 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AGREEMENT SURETY January 10, 1989 United Pacific Insurance Company Bond No. U1438945 RESOLUTION NO. 91/6 Y Completion of Improvements for Subdivision 7108 January 8, 1991 Page Two BE IT FURTHER RESOLVED that there is no need for a one year warranty period and the Public Works Director is AUTHORIZED to refund the $5300 cash security for performance (Auditor's Deposit Permit No. 148744, dated November 22, 1988) plus interest in accordance with Government Code Section 53079, if appropriate, to Grupe Company pursuant to the requirements of the Ordinance Code.
