HomeMy WebLinkAboutRESOLUTIONS - 10171989 - 89-693 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on October 17, 1989,by the following vote: AYES: NOES: MULTIPLE MOTIONS -- SEE BELOW ABSENT: ABSTAIN: SUBJECT: Health and Safety Code ) RESOLUTION NO. 891693 S 1442.5 Hearing Findings ) (Beilenson Hearing Findings) ) Pursuant to Health and Safety Code section 1442 .5, the Board conducted a public hearing on October 17, 1989 on proposed closure of County facilities, reductions, or elimination of the level of services in the County's Health Services Department. I. The Board received written and oral evidence, as follows: A. Written documents were received into the record, and are filed with the Clerk of the Board of Supervisors, as follows: 1 . Board Order fixing Hearing to be held October 17, 1989 at 2:00 p.m. 2 . Notice of Public Hearing. 3 . Memo of October 16, 1989 from Mark Finucane to Phil Batchelor on the impact of selected Beilenson reductions . 4 . Such other documents as may appear in the records of the Clerk of the Board of Supervisors. B. The oral testimony received is summarized as follows: 1 . Nedra Overall, 8990 McGurrin Road, Oakland, member of Public and Environmental Health Advisory Board [PHAB] , outlined the 1988 PHAB "report to the Board on the health needs of the county. She advised that PHAB strongly recommends that the Board not reduce the resources of the Public Health Division budget this year. 2. Jean Siri, 1015 Leneve Place, El Cerrito, West Contra Costa Conservation League, West County Toxics Coalition, and the Gray Panthers of West Contra Costa, urged no reductions. 3 . Doris Copperman, 3 Penrith Walk, Pleasant Hill, representing PHAB and the Advisory Committee on Aging, advised that she was pleased to see that the Brentwood Clinic was not to be closed, but she would like to see Hospice restored. 4 . Barbara Bonnickson, 613 2nd Street, Brentwood, thanked the Board for not closing the Brentwood Clinic. 5. Charity Hirsch, PA, 841 Coventry Road, Kensington, representing the Maternal, Child, Adolescent Health Advisory Board, outlined the concerns of that Board. She urged the Board to seek funds from the federal and state governments. 6. Paul Cardinet, Public Health Nurse, Health Department, Concord, representing the Public Health Nursing Unit, opposed the proposed reductions in funding two Public Health Nurse Supervisors and one Registered Nurse Supervisor in Public Health Nursing. 7 . Peggy- Silva, Public Health Nurse, Health Department, Concord, representing the Public Health Nursing Unit, opposed the proposed reductions in funding for Public Health Nurse Supervisors. 8. Susan Guest, 550 School Street, Pittsburg, Public Health Nurse in East contra Costa County, objected to the proposed cut in funding the Supervising Public Health Nurses. 9 . Georgia Lacey, Public Health Nurse, Richmond, urged the Board not to cut the Public Health Nursing program. 10. Leslie Frech, 925 Avondale Court, Walnut Creek, Public Health Nurse Supervisor, expressed opposition to the elimination of the Public Health Nurse Supervisors. 11. Karen Jorgensen, 1111 Ward Street, Martinez, Supervising Public Health Nurse, urged the Board not to make any cuts in Public Health Nurse Administration. 12. Elaine G. Swenson, RN, MPH, Public Health Nurse, Richmond, advised that the nurses wished to submit to the Board their alternative plan for revenue savings. 13 . Philip Bertenthal, Contra Costa Legal Services Foundation, commented on certain obligations he thinks the County has in delivering health care to the indigent. 14 . Joseph Goglio, 525 Green Street, Martinez, representing the AFL/CIO Central Labor Council, commended the Board on its broad support of public services and past support of occupational health services at the Richmond Clinic, and urged that support be maintained. 15. Barbara Guise, Councilmember from the City of Brentwood, thanked the Board for not closing the Brentwood Clinic. 16 . Arthur Hollister, M.D. , 14 Boles Court, Pleasant Hill, representing the ACCMA on the Adult Day Health Care Council, expressed concern about the possible loss of the Healthy Older Adult Program through the proposed reductions before the Board. 17 . Mark Finucane, Health Services Director, noted that the Department will, by November 14, 1989, make a further report on the proposed reduction in Public Health Nursing Supervisors. -2- r , II. Findings. c On the basis of the foregoing evidence, the Board makes the following findings: A. Notices of Public Hearing were posted on' or before September 17, 1989 and such notices and postings were in compliance with Health and Safety Code S 1442 .5 . B. "Indigents, " for the purposes of Health and Safety Code section 1442 and the Board's October 17, 1989 legislative hearing pursuant to Health and Safety Code section 1442.5, are those persons who are eligible for General Assistance under the standards adopted by Resolution No. 89/598. C. Pursuant to Health and Safety Code S 1442.5, all interested persons were allowed to speak and/or provide written comments at the hearing on October 17, 1989 . D. The following proposed reductions or changes, which were included in the posted Notice of Public Hearing, are eliminated from consideration by the Board and will not be implemented: 1. Main Detention Facility reductions in nursing staff and for self-medication; 2. Marsh Creek Detention Facility reductions; 3. Taxi service reductions; 4 . Specialty Clinic reductions, excepting the Anesthesiology Pain Clinic; 5 . Brentwood Clinic closure; and 6 . Public Health Nursing reductions. This action (Section II .D. only) is taken by the- following hefollowing vote: AYES: Supervisors Powers, Fanden, Schroder,' Torlakson NOES: Supervisor Weak ABSENT: None ABSTAIN: None E. The following reductions or changes were considered at the public hearing on October 17, 1989 and were included in the Notice of Public Hearing: 1. Main Detention Facility family nurse practitioner and medical records reductions; 2. Hospice Program elimination; 3. Rehabilitation Services Director elimination; 4. Anesthesiology Pain Clinic elimination; 5. AIDS program reductions; 6 . Communicable Disease Control Program reduction; 7 . Public Health Nursing Supervisor reductions; and 8. Miller Center reductions. —3- r F. The public hearing on the proposed reduction of Public Health Nursing Supervisors is continued to November 14, 1989, at 9 :30 a.m. G. As to the other reductions and changes considered at the public hearing on October 17, 1989, the Board finds as follows: 1 . The reductions at the Main Detention Facility in the family nurse practitioner staff and in the medical records clerical staff will not reduce any mandated medical services and will not affect the level of medical care services to indigents . 2 . The Hospice Program is not a mandated or medically necessary service; hospice services are available from other hospice programs in the County; and elimination of the Hospice Program will not affect the level of medical care services to indigents . 3 . The position of Medical Director of Rehabilitation Services is not mandated and' does not provide medically necessary services . Elimination of the position of Medical Director of Rehabilitation Services will not affect the level of medical care services to indigents and the functions of the director will be absorbed by existing staff . 4 . The Anesthesiology Pain Clinic is not a mandated or medically necessary service. Elimination of the Anesthesiology Pain Clinic will not affect the level of medical care services to indigents and the service will be otherwise provided by the referral of patients to their primary care physicians . 5. The positions in the AIDS Program and the Communicable Disease Control Program are not mandated and do not provide medically necessary services . The elimination of one FTE Communicable Disease Technician in the AIDS Program and the elimination of the single FTE Health Services Administrator-A in the Communicable Disease Control Program will not affect the level of medical care services to indigents . 6 . The Mental Health Treatment Specialist position at the Miller Center is not mandated and does not provide medically necessary services . The elimination of one part-time Mental Health Treatment Specialist position at the Miller Center will not affect the level of medical care services to indigents . H. There will be no detrimental impact on the health care needs of the County's indigents from the changes and reductions approved herein. I . All of the program changes and reductions considered by the Board on October 17, 1989 are approved, except the issue of the proposed Public Health Nursing Supervisor reductions, which is continued to November 14, 1989, at 9:30 a.m. III . If any finding herein is held invalid, such invalidity shall not affect findings which can be given effect without the invalid provision, and to this end, the invalid finding is severable. -4- IT IS BY THE BOARD ORDERED that neither the inclusion of a proposed change in a program in the Notice of Public Hearing, the holding of a hearing with respect to a change in a program included in the Notice of Public Hearing, not the making of a finding as to such a change, is to be construed as an admission by the County of Contra Costa or by the Board that any of the program changes covered by the Notice are subject to the provisions of Health and Safety Code sections 1442 or 1442.5. IT IS FURTHER ORDERED that this resolution be included as a part of the official public hearing record and that the Health Services Director is directed to implement the changes approved herein and submit such further action to the Board as may be necessary.
