NOES: None . ABSENT: None. ABSTAIN: None . SUBJECT: Hazardous Materials Release ) 88/21 Response Plans and Inventory ) Resolution No. Program - Area Plan Approval ) 1. Health and Safety Code Chapter 6.95 (commencing with $ 25500) requires each county to establish a Hazardous Materials Release Response Plans and Inventory Program to assist emergency rescue personnel to prepare adequately for emergency responses or potential releases of hazardous. materia'ls. Specifically, Chapter 6.95 required each County to develop an Area Plan, Inspection Plan and Data Management Plan, for submission to the State Office of Emergency Services (OES). 2. The Contra Costa County Health Services Department (HSD) completed development of the Area, Inspection and Data Management Plans as required by Chapter 6.95 which were submitted to State OES. 3. State OES received the Contra Costa County Hazardous Material Area Plan and returned comments to the County HSD. These State comments must now be included in a revised County Area Plan. 4. State OES comments, input from Health Services, Law Enforcement, Fire Services, County Office of Emergency Services and other interested parties have been included in the January 5, 1988 Revised C.C.C. Hazardous Material Area Plan. 5. Implementation of the January 5, 1988 Area Plan is contingent upon realignment of program responsibilities between the Administering Agency (Health Services) and the Office of Emergency Services. Upon completion of this realignment, the County Administrator will direct the HSD to implement this plan. Now, therefore, it is hereby RESOLVED that: 1. The Area Plan is accepted, but implementation is contingent upon County Administrators direction to the Health Services Department. 2. The accepted Area Plan shall be submitted to State Office of Emergency Services by the Health Services Department before January 15, 1988. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Super* ors on the date shown. The requirements of California Health and Safety Code, Division 20, Chapter 6.95, Section 25500 (et. seq. ) will not be met. B. The requirements of California Administrative Code Title 19, Articles 3 and 4 will not be met. C. Contra Costa County will be beyond the legislated deadline for submission of a revised Area Plan. D. RECOMMENDED ACTION: A. Adopt the attached Contra Costa County Hazardous Material Area Plan, Revision January 5, 1988 (Attachment 1). II. FINANCIAL IMPACT: A. Regulated Community - The costs of administering the Area Plan are included in Board Approved Hazardous Material Release Response Plans and Inventory Program fees. B. County General Fund - There will be an undetermined County cost as a Hazardous Material First Responder and Incident Commander training are made available to Fire, Law Enforcement and Health personnel in response to Federal OSHA (29 CFR 1910) and State Office of Emergency Services (CAC Title 19) requirements. C. Administering Agency Fees - The Health Services Department has budgeted $10,000 in the first two years for conducting interagency training on the protocols and procedures contained in this plan. III. REASON FOR RECOMMENDATION: A. The submission of this revised plan is mandated by California Health and Safety Code, Division 20, Chapter 6.95, Section 25500 (et. seq) . B. The Contra Costa County Hazardous Material Area Plan was accepted by the Contra Costa County Hazardous Commission on December 23, 1987.
