The last paragraph of the preamble is amended to read as follows: "The rates set forth in this resolution are for 24-hour care and supervision of children placed in foster care facilities by either the Social Service or Probation Departments; or those children placed by the Mental Health Department pursuant to AB 3632, i.e. , Seriously Emotionally Disturbed (SED) children. These facilities may be either licensed/approved family homes, small family homes or licensed . group homes. The term "family home" includes foster family homes, small family homes and the homes of both relative-caretakers and nonrelated legal guardians. " 2 . Paragraphs 1 . , b. and c. relative to General Provisions are amended to read as follows: "b. AFDC-FC rates previously established in Resolution No. 85/440 adopted on July 23 , 1985; Resolution No. 84/232 adopted on April 17, 1984 and Resolution No. 84/655 adopted on October 30, 1984 have been carried forward and augmented as required by regulations of the State Department of Social Services. c. That portion of Resolution No. 85/440 adopted on July 23 , 1985 which set County rates for Specialized Foster Care Homes is hereby superseded. Those portions of Resolution No. 85/440 which set County rates for all other foster home care are carried forward. " 3 . Paragraphs 2. , b. , 2 ) , a) through c) , ( 4) relative to Specialized Foster Care Homes are amended to read as follows: "a) The maximum initial monthly specialized care rates for Probation, Mental Health and Social Service Department placements in specialized foster care in Contra Costa County shall consist of a basic component (as specified in 2. , a. above) established in accordance with the statewide standardized schedule and a "Difficulty of Care" allowance [as specified in 2. , b. , 1) above] based on each child' s specialized care need established in accordance with the provisions of welfare and Institutions Code §11461(d) . For children eligible to receive AFDC-FC or AB 3632 SED payments, the specialized care rate shall be paid from AFDC-FC funds or AB 3632 SED funds, as appropriate. For children not eligible to receive AFDC-FC or AB 3632 SED, the specialized care rate shall be paid from County funds. RESOLUTION NO. 8.7/623.. -1- b) Additional $20 (maximum) increments may be provided effective November 1, 1984 by contract at interval of not less than sex months from County-Only funds, upon satisfactory completion of required training up to a maximum of $80 over the initial monthly AFDC-FC rate as set forth in a) above. c) Subject to payment limits pursuant to Government Code §25502. 5, and in accordance with the above provisions, the Purchasing Agent -is authorized to contract with licensed, specialized foster care providers effective November 1, 1984 to pay ( from County-Only funds) for training noted above and vacation/respite care as follows: ( 1) These contracts shall be limited to Probation, Social Service Department, or Mental Health Department placements of children ages 7-19 in homes with up to four long-term beds. No more than 36 beds shall be filled at any one time. ( 2) In the case of specialized foster care contractors providing long-term care, the contracts may make provisions for alternate care to be provided to the child(ren) placed in each home to allow each contract home the following: ( i) Two days of respite for each full month of care may be provided up to a maximum of 22 days per fiscal year. Respite days must be used in the month accrued and no respite days will be accrued during any months in which vacation is taken. (ii) Homes which have provided care for at least twelve months may receive a maximum of 14 days of vacation per child during each fiscal year, subject to regulations developed by the County Welfare Director. Vacation time must be used by the end of the fiscal year following the year of accrual. ( 3 ) In the case of specialized foster care contractors providing respite care only, the provisions set forth in ( 2 ) above shall not apply. (4) Payment to specialized foster care providers for. respite and vacation shall be from County-Only funds. Such payments shall be authorized as follows: ( i) the maximum allowed for respite care shall be one-tenth of the specialized foster home' s monthly rate per bed. ( ii) the maximum allowed for vacation care shall be the specialized foster home' s monthly rate prorated on a daily basis. " RESOLUTION NO. 87/623 - -2- 4. Paragraph 2. , b. , 3 ) , c) , ( 1) relative to Emergency Foster Homes - Social Service Department, is amended to read as . follows: "c) Subject to payment limits pursuant to Government Code §25502 . 5, and in accordance with the above provisions, the Purchasing Agent is authorized to contract with licensed emergency foster home providers for the retainer fees noted above, as follows: ( 1) For Social Service placements of children ages 0-17 , not more than 75 beds at any one time, and not more than five beds per home. " 5. Paragraph 3. relative to Group Home Payment Rates is amended to read as follows: "The maximum monthly AFDC-FC payment rates for Probation, Mental Health, and Social Service Department placements in group homes shall be the group home program rate established by the State Department of Social Services pursuant to Welfare and Institutions Code §11462 . These rates shall be subject to adjustments for cost of living or allowable cost changes, made in accordance with written directions from the State Department of Social Services as authorized by Welfare and Institutions Code §11462. For children eligible to receive AFDC-FC or AB 3632 SED payments, the group home rate shall be paid from AFDC-FC funds or AB 3632 SED funds, as appropriate. For children not eligible to receive AFDC-FC or AB 3632 SED, the group home rate shall be paid from County funds.
