ABSENT: None, ABSTAIN: None . -------------------------------------------------------------------------- -------------------------------------------------------------------------- SUBJECT: Determination of Property Tax ) Exchange for Castro/Hill- ) Radach Boundary Reorganization) Resolution No. i87/1.7 (LAFC 86-44) ) WHEREAS, Section 99 of the Revenue and Taxation Code provides that the City and the County shall agree by resolution to exchange property tax revenue among themselves and any affected agency in the event of a jurisdictional change; and WHEREAS, the Castro/Hill-Radach Boundary Reorganization (LAFC 86-44) involves annexation of territory to the City of Richmond and the concurrent detachment of such territory from West County Fire Protection District (WCFPD) and County Service Areas P-6 (CSA P-6) and R-9 ( CSA R-9) for which property tax exchange is determined by the previously approved master property tax exchange agreement between the County and the City of Richmond; and WHEREAS, the reorganization also proposes concurrent annexation to the West Contra Costa Sanitary District (WCCSD) for which there is no master property tax exchange agreement in existence; and WHEREAS, in the absence of a master agreement for property tax exchange between the County and WCCSD, the County and WCCSD have agreed that the property tax exchange agreement for this annexation will be in accordance with the terms of the existing master agreement between the County and East Bay Municipal Utility District (EBMUD) ; THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax exchange for the affected agencies in the area of the Castro/Hill-Radach Boundary Reorganization (LAFC 86-44) shall be in accordance with the above discussed master property tax exchange agreements for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and that the Auditor-Controller is directed to first apply the terms of the master agreement between the County and the City of Richmond to the annexation of the subject territory to the City of Richmond and then apply the terms of the master agreement between the County and EBMUD to the annexation of territory to WCCSD. The terms of the master agreements as determined by this resolution shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. The terms of this resolution apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the affected districts' right to collect taxes for existing bonded indebtedness.
