ABSENT: Supervisor Powers . ABSTAIN: None. SUBJECT: Personnel Management Regulations ) Add Section 1004.1, Transfer ) Resolution No. 86/ 679 Without Examination ) In its capacities as the Board of Supervisors of Contra Costa County and the Governing Board of the Contra Costa County, Moraga, Orinda, Riverview and West Fire Districts this Board RESOLVES THAT: The Director of Personnel having advised this Board that certain employee organizations agreed to implementation of a new Personnel Management Regulation entitled, "Transfer Without Examination" during 1985-87 meet and confer nego- tiations, and that said Personnel Management Regulation needs now to be approved by the Board so as to also be made applicable to management and unrepresented employees. With respect to memoranda of understanding, it is 4 noted that where a specific provision in a Memorandum of Understanding conflicts RESOLUTION N0, 861679 with a specific provision of the Personnel Management Regulations, the provision of the Memorandum of Understanding shall prevail . 1004.1 Transfer Without Examination After consultation with the appropriate appointing authority(s), the Director of Personnel may transfer an employee from one job classification to another job classification without examination under the following conditions: (a) The duties and responsibilities of the position from which the employee is being transferred from are within the occupational area or directly associated with the duties and respon- sibilities of the position to which the employee is being transferred. (b) The transfer is deemed appropriate by a review of the particular duties and responsibilities of the position under consideration. (c) The employee must possess the minimum qualifi- cations for the job classification to which the employee is being transferred. (d) The employee must serve the probationary period required for the classification into which the employee is being transferred. RESOLUTION NO . 86/•679 (e) An employee rejected during the probationary period or who resigns during the probationary period for other than disciplinary reasons shall have the right at that time to be restored to a position in the classification in the department from which the employee was transferred. This regulation expires one year from the date of its adoption.
