HomeMy WebLinkAboutRESOLUTIONS - 11291983 - 83-1192 I �3 THE BOARD OF SUPERVISORS OF,CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 29, 1983 by the following vote: AYES: Supervisors Powers , Fanden,' McPeak, Torlakson, Schroder NOES: None r ABSENT: None ABSTAIN: None SYPJr MRing Subdivision Agreement ) RESOLUTION NO. 83/1192 and Exonerating Surety Bond, ) Subdivision MS 57-769 ) Walnut Creek Area ) On July 24, 1979, this Board approved a Subdivision Agreement with Antioch I, Limited, subdivider, wherein said subdivider agreed to complete all improvements in Subdivision MS 57-76, Walnut Creek area. On March 11 , 1980, this Board approved substitute security for said Subdivision Agreement in the form of a surety bond issued by Amwest Surety Insurance Company. The Public Works Director now informs this Board that a potential for development exists beyond this subdivision . Future developments will be required to construct a public road over this Subdivision MS 57-76. Construction of this road would require the removal of the improvements required by the Subdivi- sion Agreement for MS 57-76. These improvements, which include the extension of a drainage culvert under a private road, are not considered to be necessary until such time the adjacent upstream property is developed. The estimated cost of this culvert is $3,600. A cash deposit of $2,600 (Auditor's Deposit Permit No. 72017, dated November 9, 1983) was made and the developer has assigned the $1,000 cash deposit (Auditor's Deposit Permit No. 21460, dated July 11, 1979) to the County contingent on the surety bond being exonerated. The Public Works Director indicates that it is in the best interest of the County and the developer to terminate the agreement, exonerate the bond, and to accept the $3,600 cash contribution to be used by the County or future developers for necessary culvert work at that time. On the recommendation of the Public Works Director; NOW THEREFORE BE IT RESOLVED that the Subdivision Agreement with Antioch I, Limited, as approved by the Board on July 24, 1979, is TERMINATED, and the improvement security bond with Amwest Surety Insurance Company (Bond No. 1000444) is EXONERATED.
