Building Inspection Department BY , DEPUTY Bay Area Rapid Transit District November 5, 2002 Board of Supervisors Pleasant Hill BART Station Area Specific Plan Amendment and Rezoning/Preliminary Development Plan Page 2 FISCAL IMPACT The cost of this project has been shared by the County Redevelopment Agency and the assigned developer of the project, Ironhorse Associates. The County's portion has been included in the Redevelopment Agency budget. The Agency will be reimbursed its costs as part of a subsequent Disposition and Development/Lease Agreement. BACKGROUND/REASONS FOR RECOMMENDATONS The County sponsored a design Charrette for the Pleasant Hill BART Station Property in early 2001. The process began with a research and education phase in January 2001, followed by six days of public meetings on various topics(i.e., parking, pedestrian bridge, swim club, etc.), presentations, open studio, etc. The review and revise phase of the Charrette included two meetings in April 2001. A final meeting, focusing on the Codes was held in December 2001. Over 500 people participated in the Charrette process, which included over 85 hours of open public session. The Summary Report was accepted by the Board of Supervisors December 2001. The Rezoning and Preliminary Development Plan application is consistent with the outcome of the Charrette. Under consideration are; (1) Amendments to the Specific Plan; and (2) approval of the Rezoning and Preliminary Development Plan. Amendments to the Pleasant Hill BART Station Area Specific Plan proposed include (a) elimination of the Treat Blvd. pedestrian overcrossing at Oak Road from the Specific Plan and (b) a reduction in the building setbacks for subareas 11 and 12 (the BART property) of the Specific Plan area. The Rezoning and Preliminary Development Plan involve rezoning the site to a Planned-Unit District and the adoption of the Preliminary Development Plan, consistent with the outcome of the Charrette. The County Planning Commission considered a recommendation on these proposals and recommended approval of the Rezoning and Preliminary Development Plan and expressed some concern about the portion of the Specific Plan Amendment dealing with the pedestrian overcrossing. The concerns expressed regarding the Specific Plan Amendment were limited to the elimination of the pedestrian bridge and pedestrian safety at the intersection. The Planning Commission recommended approval of the amendment, subject to the Board of Supervisor's consideration of incorporating pedestrian safety facilities to improve pedestrian safety and ease in crossing Treat Blvd. including inclusion in the final design consideration of such things as: a. Separate crosswalk surface from Treat Blvd. asphalt such as colored pavers. b. Surface blinking lights at the crosswalk during cross cycles. c. A protected wide center island for pedestrians to a light with a walk button. d. Islands after the right turn lane islands and a right turn lane on westbound Treat turning into the BART station to narrow the width of the crossing. e. Yield to pedestrians at the right turn from northbound Oak onto Treat going east. Left turn signal from southbound Oak going east on Treat so it doesn't conflict with the pedestrian movement. g. Inclusion of a countdown pedestrian signal. Staff has reviewed the pedestrian safety facilities suggested by the Planning Commission. From a maintenance standpoint, the separate crosswalk surface (i.e., pavers) would be of concern for long-term viability of a paving material other that asphalt for the busy Treat Blvd. Staff concluded that this will not significantly enhance safety since the there is a traffic signal at the crossing location. While additional painting the asphalt for a high-visibility treatment could be considered, the standards dictate that this treatment be limited to intersections that are not signalized. Surface blinking lights on the crosswalk are contrary to current practice because the crossing is already signalized. This treatment is still experimental and are limited to non- signalized pedestrian crossings. The Redevelopment Agency commissioned a traffic study for the proposed removal of the bridge. The idea of an island refuge was considered, however, it was not recommended to be implemented because there is not adequate width in the current medians. Additional width would be necessary to have the six ft width needed for a pedestrian island refuge. This would require frontage widening and associated tapers. The suggestion of islands at the right turn lane from westbound Treat Blvd. to northbound Oak Road (the BART Station) already exist. Yielding to pedestrians that have the right-of-way is already the law. The County has standard "Observe the pedestrian right-of-way" signs that could be added to the all legs of the intersection. The traffic engineer confirmed that the existing eight-phase traffic signal cycle currently does not give a pedestrian right-of-way in conflict with a left-turn movement. The countdown signal is a feasible suggested feature that can be explored for this intersection and subject to approval of the California Traffic Control Devices Committee. Staff is currently in the design phase of the Ironhorse Trail (Treat Blvd. at Jones Road) overcrossing, which includes adding a right-turn lane from northbound Oak Road onto Treat Blvd. The pedestrian enhancements discussed could be evaluated further, incorporated into the design as appropriate and brought forward to the Board for consideration. The Rezoning and Preliminary Development Plan under consideration are consistent with the outcome of the Charrrette. Consideration of the Preliminary Development Plan includes adoption of the Regulating Plan, Principles and Regulations and Architectural Codes. Although these Codes provide a far higher level of detail than that which is required for a Preliminary Development Plan, the Codes provide assurances that the future plans as they brought forward in the Final Development Plan is consistent with the development and design consensus for the BART property from the Charrette will be consistent. Many of the finer details of the plan, such as the road improvements on Jones Road, will be designed with the Final Development Plan. A"Town Architect"has been retained to work with the developer, their architect, and County staff in developing subsequent site plans,elevations and use programs consistent with the preliminary development plan and Codes. Undertaking these steps will assure that a Final Development Plan(s)for the site will consistent with the Charrette outcome. As required by County Code Final Development Plan hearings will be public and include public notice. BE IT FURTHER RESOLVED, that the County Planning Commission makes the following findings pursuant to the Contra Costa County General Plan Growth Management Element and County Code Sections 84-66.1406. 1. Growth Management Element Performance Standards Findings a) ;Traffic: Traffic impacts have been addressed in the DEIR for the Pleasant Hill BART Station Specific Plan. A comparison of the proposed project's trip generation characteristics with the alternatives evaluated in the 1998 EIR shows that the traffic generated by the project is within the lower and upper range of impacts and mitigation measures identified in the 1998 EIR. b) Water: Contra Costa Water District indicated they have capacity to serve the project. e) Sanitary__Sewer: The project is within the boundaries of the Contra Costa Central Sanitary District, service is planned for the area. d) Fire Protection: The subject property is within the Contra Costa Fire Protection District Boundaries and the project is required to comply with all of the District's requirements, including the payment of fees. e) Public Protection: Although no comments were received from the Sheriffs Department on the Preliminary Development Plan, staff expects comments from the Sheriffs department when the plans are more detailed when the Final Development Plan(s) are submitted. f) Parks and Recreation: Park dedication fees are required per County Ordinance for residential projects. The fee is used to provide parks/recreational opportunities within the area and would offset any impacts to parks. g) Flood Control and Drainage: The project will be required to meet all collect and convey requirements. 2. Findings For Approval Of A Preliminary.Development Plan: The proposal is consistent with Section 84-66.1406 of the zoning ordinance which requires the following findings be made prior to granting the preliminary development plan approval: a) The applicant intends to start construction within two and one-half years from the effective date of zoning change and approval. The applicant has expressed their desire to begin construction of the beginning phase of the proposed project once the plan is finalized and afnal development plan is approved. b) The proposed planned unit development is consistent with the County general plan. The proposed project is consistent with the mixed-use general plan designation, the policies of the Pleasant Hill BART Station area Specific Plan, and compatible with other uses in the vicinity. c) In the case of residential development, it will constitute a residential environment of sustained desirability and stability, and will be in harmony with the character of the surrounding neighborhood and community, The proposed development locates high- density residential uses inclose proximity to existing residential uses. The project is located at a transit center, near existing and proposed neighborhood retail services. d) In the case of commercial development, it is needed at the proposed location to provide adequate commercial facilities of the type proposed, and that traffic congestion will not likely be created at the proposed center, or will be obviated by presently projected improvements and by demonstrable provisions in the plan for proper entrances and exits,and by internal provisions for traffic and parking,and that the development will be an attractive and efficient center which will fit harmoniously into and will have no adverse effects upon the adjacent or surrounding development. The proposed commercial development meets the policies of transit-oriented development and the Pleasant Hill BART Specific Plan. Traffic impacts have been adequately addressed in the 10BIR for the Pleasant dill BART Specific Plan. No variances to the number of parking spaces are requested. e) The development of a harmonious, integrated plan justifies exceptions from the normal application of this code. The planned-unit zoning district is the appropriate zoning designation for the proposed project and is consistent with the principles of transit-oriented development, and the goals of the Pleasant Hill BART Station Area Specific Plan and County General Plan. THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA Adopted this Order of November 5,2002,by the following vote: AYES: Supervisors Uilkema,Gerber,DeSaulnier,Glover and Gioia NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.2002/719 SUBJECT: IN THE MATTER OF AMENDMENTS TO THE PLEASANT HILL BART STATION AREA SPECIFIC PLAN The Board of Supervisors of Contra Costa County RESOLVES that: WHEREAS, there is filed with this Board and its clerk a copy of Resolution No. 33-2002, adopted by the County Planning Commission,which discusses proposed amendments to the Specific Plan for the Pleasant Hill BART Station Area(#SP2002-02). The resolution makes reference to the proposed amendments related to building setbacks for Sub areas 11 and 12 and the elimination of the Treat Blvd. pedestrian overcrossing at Oak Road. WHEREAS, on November 5, 2002,the Board held a hearing on said Specific Plan Amendments discussed by the Planning Commission Resolution 33-2002. Notice of said hearing was duly given in the manner required by law. The Board, at the hearings called for testimony of all persons interested in this matter. After taking testimony,the Board closed the public hearing. WHEREAS, the Board finds that the proposed Amendment to the Specific Plan will not have a significant impact on the environment. An Environmental Initial Study, Mitigated Negative Declaration, and Mitigation Monitoring Program was prepared and adopted by the Board, after having considered all comments received thereon, for the Pleasant Hill Bart Station Area Specific Plan Amendments. These actions satisfy the requirements of the California Environmental Quality Act and County CEQA Guidelines. WHEREAS, the Board members having fully considered these Specific Plan Amendments discussed in Resolution No. 33-2002, the recommendations included in the County Community Development Department staff report dated November 5, 2002, hereby adopts the Amendment to the Specific Plan related to the reduction of building setbacks for Sub areas 11 and 12. The Board dcferred consideration of the Amendment to the Specific Plan related to the elimination of the Treat Blvd. overcrossing at Oak Road until such time that a Final Development Plan is considered for the BART property. The Beard further resolved that although the developer of the BART property would be required to participate in the financing of the bridge, no money should be collected from the developer to pay for the bridge until a final decision related to the bridge is made.
