SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS: ADOPT "support" position on the East Bay Regional Park
District's Proposed Measure WW, a regional open space, wildlife, shoreline and park
bond that continues and extends provisions of Measure AA approved by voters in
1988, as recommended by Supervisors Gioia and Glover.

BACKGROUND/REASONS FOR RECOMMENDATIONS: As the Board's appointed
representatives to the Liaison Committee established by East Bay Regional Park
District ("EBRPD") Board of Directors and the Contra Costa County Board of
Supervisors, we have received regular updates from EBRPD on their efforts to develop
a bond measure for consideration by voters. In July 2008, the East Bay Regional Park

District Board of Directors voted to place a $500 million park bond extension measure on the
November 4 ballot. The proposition, which has the ballot designation of Measure WW, would
replicate and extend the successful $225 million bond measure (Measure AA) passed in 1988
without raising the present property tax rates above the present rate of $10 per year, per
$100,000. Measure WW requires a two-thirds vote to be approved.
Of the $500 million.raised by Measure WW, $375 million (75%) will fund regional park
acquisitions and capital projects, with $26:2 million (7%) held in reserve for unanticipated .
future needs and opportunities. In addition, $125 million (25%) of proceeds will go to cities,
special park and recreation districts, and county service areas for their park and recreation
services. The attached brochure provides additional information on the measure.
We believe Measure WW will provide substantial benefits to the County and its residents. The
measure will provide funding to acquire and protect open space and shoreline areas. These
acquisitions will serve a growing population and protect our beautiful Contra Costa County
landscape. The measure will provide critical funds for regional trails that are enjoyed and
relied upon by thousands of residents, including new segments of the Iron Horse Trail, the Bay
Trail and the Bay Area Ridge Trail as well construction of the new Delta Trail. The measure
will complement and provide matching funds for habitat conservation efforts throughout the
County, including those associated with the East Contra Costa County Habitat Conservation
Plan that is currently being implemented by the County and participating cities. The measure
will also provide funding for environmental education and other facilities intended to benefit
children. Finally, the measure will include critical funding to the County and the cities for local
parks, including approximately $7.9 million for local parks for unincorporated regions of Contra
Costa County. Of this amount, approximately $1.2 million would be allocated to Community
Services Districts ("CSDs") such as the Town of Discovery Bay' that provided park services in
unincorporated areas and approximately $6.7 million would be allocated to the County for the
areas it servesz.
One area of discussion with EBRPD has centered on the availability of local park funds to the
County: We have sought assurance from EBRPD that the County would be treated in a
manner equivalent to the cities with respect to how these funds would be allocated. EBRPD
has provided us with assurance that, for those unincorporated areas not served by an
independent local district such as a CSD, the County is the intended recipient of the funds. As
is the case for the cities, the County must propose specific projects to which the funds will be
allocated. EBRPD will retain its fiduciary responsibility and authority to determine that projects
proposed by the County are of a kind consistent with the measure and are in locations that
meet the requirements of the measure for geographic equity. We have requested a letter to
this effect from EBRPD in advance of the Board meeting as well as a commitment that, should
the measure pass, EBRPD be willing to enter into a Memorandum of Understanding to further
document this arrangement during implementation of the measure.
For the reasons outline above, we recommend that the Board adopt a position of support.

Re: Measure WW Local Grant Funds, Unincorporated Contra Costa County
Dear Chairman Glover.
In August 2008, the East Bay Regional Park District Board of Directors voted to place Measure
WW, a $500 million park bond extension-measure on the November 4' ballot. The bond
initiative must be approved by two-thirds of voters in Alameda and Contra Costa counties.
Measure WW would authorize $125 million (25%) of the bond proceeds to fund local park and
recreation projects through a per-capita grant program to Cities and other local agencies. If
approved by the voters, the grant program would reimburse agencies for eligible expenses on
local parks and recreation projects after submission of the appropriate project application
materials and project documentation. -
Consistent with the prior Measure AA program, eligible local agencies named in the measure
with per-capita allocations of funds include the various agencies serving the unincorporated
areas of the County. These include independent special districts such as local Park and
Recreation Districts and Community Service Districts, and the County, which is responsible for
providing local park and recreational services in County Service Areas. County representatives
have requested affirmation of the District's intention with respect to the unincorporated areas
not served by these independent special districts.
This letter is to confirm first that the allocations named in the Measure WW distribution list
for all dependent special districts, county service areas, and similar identified populations will be
contracted with the County as the designated responsible entity, and that the District will
process, consistent with the Local Grant Guidelines and provisions of the measure, any and all
projects that the County determines are in the best interests of these areas.
Further, per the County's request, I would like to confirm that with respect to the remaining
unincorporated areas, the District intends to solicit from the County, as the primary service
provider for these areas, the park and recreation project proposals for the unincorporated
areas. The District intends to appropriate these funds to the projects conducted by the
County or to projects proposed by the County but performed by others. Of course,as the
agency with ultimate fiduciary responsibility for carrying out the will of the voters, the District
must retain discretion to confirm that Local Grant Program expenditures and distributions are
consistent with the intent and provisions of the Measure.

The District retains such discretion for both city and county allocations under the Local Grant
Program and intends that local grant disbursements to all agencies are treated similarly.
Upon passage of the Measure, the District will be pleased to work directly with the County to
finalize the population numbers and allocations, and to assist the County as necessary with
developing the right mix of projects that insure the equitable distribution of the Local Grant
Program funds throughout the unincorporated areas of the County. Should the County desire,
the District would be willing to enter into a Memorandum of Understanding(MOU) with the
County to further detail and document this understanding. Such MOU could include additional
detailed sub-allocations of funds for various communities within the unincorporated area.
Measure WW, should it pass, will enable the District to provide significant funding to hundreds
of local projects, and we have a strong interest in establishing an efficient means of review,
authorization and reimbursement to local entities. The County is an important partner in this
process, both in achieving community consensus on the projects serving the unincorporated
populations, and in serving as the responsible fiscal agent to conduct the work and receive the
reimbursement upon project completion. We look forward to both the County's leadership in
coordinating this process, and receiving the County's proposal when the Local Grant Program
is initiated in early 2009.
