SUBJECT: LEASE FOR THE PREMISES AT 4585 PACHECO BOULEVARD,
MARTINEZ, FOR THE HEALTH SERVICES DEPARTMENT

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION
1. APPROVE a Lease with Mencius, L.L.C., for a ten-year term beginning November 1, 2009, and
ending October 31, 2019, for approximately 12,160 square feet of office space and
approximately 3,575 square feet of warehouse space at 4585 Pacheco Boulevard, Martinez, at
a monthly rent of $26,020, for occupancy by the Health Services Department Hazardous
Materials Division, under the terms and conditions more particularly set forth in the Lease.
2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the Lease on behalf
of the County, and to EXERCISE any additional options to the Lease.
3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the
California Environmental Quality Act (CEQA).
4. DIRECT the Department of Conservation and Development Director, or designee, to file a
Notice of Exemption with the County Clerk, and DIRECT the Director of General Services, or
designee, to arrange for the payment of the handling fees to the Department of Conservation
and Development and County Clerk for filing of the Notice of Exemption.
FINANCIAL IMPACT
The Lease will obligate the County to pay a total rent of $3,325,800 over the ten-year term. The
Lease costs will be budgeted in the Health Services Department's FY 2009/2010, and subsequent
budgets.

SERVICES DEPARTMENT
BACKGROUND
The County's Health Services Department currently leases space at 4333 Pacheco Blvd. in Martinez
at an annual cost of $185,233, and at 1350 Arnold Dr. in Martinez at an annual cost of $36,605, for
the operation of its Hazardous Materials Division. The Health Service Department has determined
that it requires a larger facility to provide it's Hazardous Materials services for the County. The Health
Services Department will combine both of the above operations into a larger, customized building of
12,160 square feet of office space, including a laboratory, and a 3,575 square foot garage for its
trucks and equipment at an annual rental cost of approximately $360,432. The Hazardous Materials
Division will increase its fees to cover the additional costs. Approval of this lease provides for
centralization and necessary expansion of the Hazardous Materials Division which is not possible at
the 4333 Pacheco Blvd., Martinez facility, due to the limited size of that building.
This new office space and warehouse will require some physical improvements prior to occupancy by
the Health Services Department. These improvements will cost an estimated $1,146,320 of which
$328,320 will be contributed by the landlord. The remaining $818,000 will be funded from the current
year budget by the Health Services Department.
